Implementing acts are how primary EU legislation translates into operational detail. They typically specify technical standards, procedural requirements, or implementation methodologies that the primary legislation references but does not itself define. Under the EU AI Act, several obligations rely on implementing acts for full operational definition, including watermarking technical standards, conformity assessment templates, and post-market monitoring formats. Implementing acts go through the comitology procedure, involving Member State representatives and a parliamentary scrutiny phase. Practitioners should track implementing acts as the place where high-level regulatory obligations become engineering and compliance requirements.
The EU AI Act's mandatory watermarking obligation, taking effect 2 December 2026, will be operationalized through an implementing act that defines the technical standard for watermark embedding and detection. Until that implementing act publishes, engineering teams scoping watermarking proofs-of-concept must work from likely reference standards such as C2PA Content Credentials rather than a definitive specification.
